Gift Card - Terms and Conditions

The following terms and conditions pertain to gift cards issued by Travelswap. By engaging in the creation, utilization, accrual, and/or redemption of the gift card, you, the "Member," acknowledge and agree to abide by these terms and conditions

Usage

The value of the gift card can solely be utilized for the purchase of eligible products on www.travelswap.xyz and must adhere to the rules and guidelines outlined in these terms and conditions. To employ gift card credits, possessing an active account with Travelswap is mandatory. Transactions are debited from the redeemer's Wallet balance. Any remaining unused balance stays linked to the redeemer's Travelswap account and is applied to future purchases based on the earliest expiration date. Should a purchase exceed the redeemer's Wallet balance, the remaining amount must be promptly settled using an alternative, accepted payment method.

Fraud

In instances of suspected fraud, misuse, or inappropriate behavior, Travelswap reserves the unilateral right to close the account without prior notice, resulting in the forfeiture of all Credits (which will be immediately confiscated, expire, and canceled). Travelswap also retains the authority to debit the account of any Member who has acquired Credits improperly or in violation of the stipulations in these terms and conditions.

Risk of Loss

Upon the electronic transmission of the Gift Card to the purchaser or designated recipient, the risk of loss and title for Gift Cards transfer to the purchaser. Travelswap holds no responsibility if a Gift Card is lost, stolen, destroyed, or utilized without the owner's permission.

Limitation of Liability

WE DO NOT PROVIDE ANY WARRANTIES, EXPRESS OR IMPLIED, REGARDING GIFT CARDS, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS MAY NOT PERMIT LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF SPECIFIC DAMAGES. IF APPLICABLE TO YOU, SOME OR ALL OF THE AFOREMENTIONED DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY, AND ADDITIONAL RIGHTS MAY BE GRANTED.

Disputes

Any dispute or claim related to Gift Cards will be resolved following the Dispute Resolution section of the Travelswap Terms and Conditions.

General Terms

Travelswap retains the discretion to cancel, replace, and modify these gift card terms and conditions (including the accumulation and redemption structure) periodically without prior notice. All terms and conditions are applicable within the limits permitted by law. No claims for damages against Travelswap by Members may be filed due to legally mandated alterations specific to individual countries.
